Important Information About Ordering, Pricing, Delivery and Your Consumer Rights

These Terms and Conditions of Sale outline the agreement between you and C&J Marine Ltd when purchasing any of our products or services. By placing an order through our website, by phone, or via email, you agree to the terms detailed below.

Our aim is to provide complete clarity on how we manage orders, payments, pricing, custom-made products, delivery arrangements, returns, warranties, and your consumer rights. We encourage all customers to read these terms carefully before making a purchase to ensure you fully understand the conditions that apply to your chosen products—especially made-to-measure and customised items.

1. Definitions

1.1 Company: C&J Marine Ltd
1.2 Customer: Owner, end user, or client purchasing goods or services
1.3 Goods: All covers, canopies, upholstery, canvas goods, equipment, services, and associated products supplied by the company

2. Quotations & Estimates

2.1 All quotations and estimates, whether written or verbal, are given in good faith and are valid only for the period stated.
2.2 Quotations are based on specifications, information, material availability, and labour costs known at the time.
2.3 We reserve the right to revise any quotation or estimate should further information become available or circumstances beyond our control arise.
2.4 Any delivery or completion date provided is an estimate only and is not guaranteed, though delivery will be within a reasonable timeframe.

3. Orders & Order Acknowledgement

3.1 A sales order acknowledgement forms the basis of our works order and reflects the details used to fulfil your order.
3.2 You must check all details thoroughly and notify us immediately of any errors or required amendments before production begins.
3.3 We are not responsible for delays or inaccuracies resulting from incorrect, incomplete, or late information supplied by the customer.
3.4 Orders will not be processed, and production slots will not be allocated, until the required deposit or full payment has been received.

4. Deposits & Payment Terms

4.1 For orders under £1,000, full payment is required at the time of placing the order.
4.2 For orders over £1,000, a non-refundable 50% deposit is required to confirm and secure the order.
4.3 The remaining balance must be paid in full prior to the collection, dispatch, installation, or delivery of goods.
4.4 No goods will be released until payment has been received in full.
4.5 Orders placed online require full payment at checkout.
4.6 An invoice will be raised once goods are completed in-house and ready for collection, dispatch, or installation.
4.7 Late or overdue payments may accrue interest at 4% per annum above the Barclays Bank PLC base rate, calculated daily.
4.8 An administration fee of £25.00 + VAT may be charged for each formal reminder issued.
4.9 Credit and commercial debit card transactions may be subject to a 2% transaction fee.
4.10 Value Added Tax (VAT) is chargeable in accordance with current HMRC regulations.

5. Production, Lead Times & Delays

5.1 All production lead times are estimates and may vary seasonally or due to supply chain demand.

Designs on File

5.2 Designs held on file but made to order require a minimum production lead time of 4 weeks.
5.3 Designs stored in our database were created for specific vessels. Minor variations may occur.

Bespoke Designs

5.4 Bespoke items are those requiring measuring, templating, scanning, or design intervention.
5.5 Bespoke items require an additional minimum 4 weeks beyond standard production lead times.

5.6 Delays caused by weather conditions, access restrictions, material shortages, unavailable information, or circumstances beyond our control may result in rescheduling.

6. Customer Responsibilities & Vessel Access

6.1 Where access to a vessel is required, the customer must:

  • Inform the marina that C&J Marine may attend the vessel

  • Ensure the vessel is berthed alongside and accessible by foot

  • Notify us immediately of any access restrictions or changes to vessel details

6.2 Additional charges may apply for repeat visits caused by lack of access or incomplete information.
6.3 Marina or third-party access charges may apply and will be passed on to the customer at cost.

7. Photographs, Designs & Colour Matching

7.1 All photographs and images are for illustration purposes only and may show optional extras or historic designs.
7.2 We reserve the right to amend or improve designs, materials, fabrics, components, and specifications without prior notice.
7.3 Colour matching and shade variation may occur. Exact colour matches cannot be guaranteed and are undertaken at the customer’s discretion and risk.

8. Delivery, Dispatch & Installation

8.1 Delivery, dispatch, or installation will only occur after in-house completion and receipt of full payment.
8.2 Delivery and carriage costs are estimates and may change depending on final size, weight, and courier rates.
8.3 Delivery dates are estimates only. We are not responsible for delays caused by third-party couriers, customs processes, or unforeseen circumstances.
8.4 For international orders, all customs duties, import taxes, and local charges are the responsibility of the customer.
8.5 Goods must be inspected upon receipt. Claims for missing or damaged items must be reported within 14 working days.

9. Risk, Storage & Retention of Title

9.1 Goods remain the property of C&J Marine Ltd until paid for in full.
9.2 Goods left with us for repair, storage, or treatment are held at the customer’s risk.
9.3 Customers are responsible for ensuring adequate insurance cover.
9.4 We reserve the right of sale under the Torts (Interference with Goods) Act 1977 where applicable.
9.5 We may exercise a general lien over goods until all outstanding sums are paid.

10. Warranty & Statutory Rights (Consumer Rights Act 2015)

10.1 Goods manufactured by C&J Marine will, at the time of supply, be of satisfactory quality, fit for purpose, and as described, in accordance with the Consumer Rights Act 2015.
10.2 Manufactured goods carry a 12-month warranty from the date of invoice against defects in workmanship and materials, subject to our back-to-base inspection procedure.
10.3 This warranty is provided in addition to, and does not replace or limit, your statutory rights under the Consumer Rights Act 2015.
10.4 Goods supplied but not manufactured by C&J Marine are covered solely by the original manufacturer’s warranty.
10.5 Bespoke or made-to-measure items may require minor post-delivery adjustments. This does not constitute a fault under the Consumer Rights Act 2015 where the goods otherwise conform to the contract.
10.6 Damage caused by misuse, lack of reasonable care, incorrect installation, or extreme weather conditions is excluded.
10.7 Where goods are installed by the customer, photographic evidence of correct installation may be required.

11. Cancellations, Repairs & Weather Conditions

11.1 We reserve the right to cancel or postpone work due to unsafe working conditions, poor weather, or circumstances beyond our control.
11.2 We are not responsible for third-party costs incurred as a result of such cancellations or postponements.
11.3 Where urgent repairs are required to prevent further damage, we reserve the right to carry out such work and charge accordingly.

12. Liability & Insurance

12.1 Nothing in these Terms limits your statutory rights.
12.2 We are not liable for indirect, incidental, or consequential losses.
12.3 Our total liability is limited to the amount paid for the relevant goods or services, except where prohibited by law.
12.4 We hold Public Liability insurance of £5 million and Employers’ Liability insurance of £10 million.
12.5 Certain activities are excluded from coverage. Full details are available upon request.

13. Promotions, Discounts & Vouchers

13.1 Only one promotion, discount, or voucher may be used per order unless stated otherwise.
13.2 Promotions are subject to availability and may be withdrawn at any time.
13.3 Refunds for discounted or promotional items are based on the promotional price paid.
13.4 Refer-a-friend and voucher schemes are subject to eligibility criteria and expiry dates.

14. Data Protection (GDPR)

14.1 We comply with all applicable General Data Protection Regulation (GDPR) requirements.
14.2 Our Privacy Policy and Procedure Manual are available on our website.

15. Intellectual Property & Confidentiality

15.1 All designs, templates, patterns, and intellectual property created by us remain the property of C&J Marine Ltd.
15.2 Such materials must not be copied, disclosed, or reproduced without our written consent.

16. General

16.1 These Terms apply to all orders and supersede all previous terms and conditions.
16.2 Any amendments will be published on our website.
16.3 It is the customer’s responsibility to review the latest version prior to placing an order.
